What is WhipCar?

WhipCar is the first service in the world where a car owner can rent out their vehicle for money, whenever they are not using it. WhipCar pairs approved drivers with spare car time. We screen all cars joining the service and all drivers booking cars (see Am I eligible). The insurance WhipCar arranges protects all rentals made through the service, with an insurance product that has been created especially for our members. In the unlikely event of an accident, the vehicle owner's existing insurance is not affected. See how it works here.

Who is Eligible to Join?

In order to qualify for WhipCar, potential Drivers and Owners are screened to check that they meet our eligibility criteria. Drivers are screened via the DVLA whilst vehicles are checked through a third party provider.

Owner Eligibility
  • You must have a car (no vans, motorbikes or motorhomes at the moment)
  • It can't be more than 8 years old
  • It must have a valid MOT and road tax
  • You must have existing insurance (the policy is designed not to affect your no-claim bonus)
  • You must meet WhipCar's vehicle eligibility requirements and be suitable for use (safe to drive, in good condition and clean)
  • You can't have had a major accident in the last 3 years or written-off your vehicle
  • Cars in certain insurance ABI groups are currently not eligible for WhipCar
Driver Eligibility
  • You must be at least 21 years old (and no more than 70 years old)
  • You must have held a full UK driving licence (not provisional) for a minimum of 12 months
  • You must have no more than 6 penalty points on your driving licence
  • You can't have had any drink driving convictions in the last 5 years
  • You have no convictions relating to driving without insurance
  • You've had no more than two accidents in the past 3 years

Please note: While millions of UK cars qualify for WhipCar, we are currently unable to offer the service to cars in the highest insurance groups. If you meet the criteria above but still receive an "ineligible" message this may be why. Rest assured, we aim to expand eligibility criteria in the near future and we will contact you directly when your vehicle becomes eligible for the service.

Rental Prices (RPG)

On registration WhipCar owners set their rental own price. Our Rental Price Guidance™ (RPG) Tool provides recommended rental prices for any car added - based on the vehicle make, model and its location. You can find out what your car is worth here.

RPG represents a competitive cost for a comparable rental but should serve as a guide only, WhipCar Owners have absolute discretion to charge rates they deem appropriate.

Driver step-by-step guide

  1. Register

    WhipCar is free to join and there are no annual membership fees. To sign up as a WhipCar driver, simply fill in your details here.

    You are responsible for providing accurate details, whilst WhipCar is not responsible for the conduct of any Member using a car or any representation made by a Member.

    Aside from your personal details, your username is also important as this is what other members will see when looking at your profile. You should try and create a memorable username which cannot be obscene or profane and should not contain any third party's trademark or brand.

    WhipCar uses its best endeavours to confirm that all Drivers are approved in line with our eligibility criteria but are not responsible for any administrative errors or third party information gateways such as the DVLA database. Drivers must confirm that they are eligible within the criteria outlined prior to placing any booking and must immediately inform WhipCar in the event that their circumstances change in the interim which may affect their eligibility for the service.

    Once a Driver is fully registered, they will have their driving history checked by the DVLA to confirm that they satisfy our eligibility requirements. This driving licence check must be completed before they can book a car.

    The safety of WhipCar Drivers and Owners remains paramount and WhipCar reserves the right to reject any Driver for any reason at any time – with absolute discretion.

  2. Search

    Drivers browse WhipCar for available cars based on their chosen location.

    Within search results, Drivers can compare the rental prices, types of car and locations. By clicking on a particular profile, they can see general car details including the Owner's preferred method for pick up and which postcode it is in (but not the exact address). If this is the first time this Driver has placed a booking, WhipCar will check their driving history with the DVLA to confirm that they are eligible to use the service before sending this booking request to the Owner.

    Drivers can refine their search via the ‘Advanced Search’ feature and select specific criteria such as Fuel, Transmission, Make, Model and Body Type. Search results can be arranged by Price, Distance and Rating.

    Drivers can also select 'favourite cars' which will appear within the favourite cars section of their WhipCar profile. It allows them to quickly book their preferred cars.

  3. Book

    WhipCars can be booked up to 3 months in advance from 3 hours to 3 months at a time (depending on availability).

    Drivers place booking requests for a specific duration of time (hours, days or weeks). When you place a booking request we check that you have this balance available on your card, but no money is actually debited until this booking is accepted. We also do not take a deposit, but run a security check to ensure that you would have the appropriate funds to meet our insurance excess.

    On submitting the booking, the Owner of this car will receive a booking request alert by email and text message. Owners will always accept or decline any booking request within 2 hours. Drivers can only ever rent one vehicle at a time for a select time period and are free to request as many vehicles as they like within this. If more than one Owner accepts a rental request, the first Owner to have accepted the booking will be the car the Driver gets and all subsequent booking requests will be cancelled (for the same time period)

    When placing a booking request a Driver commits to paying the agreed payment terms including rental price, insurance, insurance tax and any excess outlined.

    Once a booking is accepted a Driver is bound by these terms and liable as per the WhipCar Cancellation and Fines Policy.

  4. Collect Car

    The Driver receives text and email reminders of booking details an hour before the booking starts.

    Prior to rental, Drivers must:
    • Show up on time (at the agreed pick up location).
    • Bring their driving licence (both the card and paper counterpart) and booking confirmation number. If this is a non-photographic licence, the Driver will need to bring an alternative photo ID (e.g. passport) to confirm their details.
    • Examine the car and check that it is free from obvious faults and other damage
    • Check the car damage log to make sure there is no unreported damage.
    • Once both parties are happy, the Owner hands over their keys and the Driver will drive away for the agreed period of hire.
    During the rental Drivers must:
    • Drive safely and responsibly.
    • Pay any charges where necessary: parking/congestion/tolls
    • If you are running late, let the WhipCar Owner know immediately and request an extension by calling 0844 544 2010.
    • In the unlikely event that you are involved in an accident or breakdown, let WhipCar know immediately by calling us on 0844 544 2010.

  5. Return Car

    An hour before the return time, both parties are sent text and email reminders of the agreed drop off time and location.

    Upon returning the car, Drivers must:

    • Return the car with the same amount of fuel prior to booking (you can agree to pay the Owner directly if there is a discrepancy).
    • Bring it back on time (or you will be fined).
    • Inform the Owner of any incidents and outline any damage.

    On returning the car both parties again assess the car. Any damage for which the Driver accepts responsibility must be flagged on an Owner's excess claims form at this time and raised by the Owner to WhipCar within 48 hours of booking return.

  6. Feedback

    Following a booking, Drivers are prompted to rate Owners whilst being as pleasant and accommodating as possible. Please provide honest feedback to help other members choose the cars they want to rent.

    Do not defame, swear or slander. If you have had a bad experience outline it honestly and rate each member as you deem appropriate. Low rated cars are unlikely to receive many booking requests just as low rated Drivers will often have their booking requests declined.

Owner step-by-step guide

  1. Register

    WhipCar is free to join. If your vehicle meets our eligibility criteria, you can add it here and start earning in minutes!

    WhipCar will automatically screen each vehicle with a third-party proprietary database to check its details, age and accident history. You can find out what your car is worth here.

  2. List Car

    Shortly after you register, your car will appear in search listings. To maximise the interest in your vehicle, make sure that you:

    • Are as descriptive and honest as possible about your car on your profile, accurately describing its condition and attributes (so Drivers know what they are getting)
    • Include a minimum of four photos of your vehicle
    • Keep your availability calendar up to date (so you don't get sent booking requests you cannot satisfy)
    • Make sure that your car condition checklist is up-to-date with any existing damage recorded
  3. Accept Booking

    WhipCar Owners have absolute discretion to accept or decline any booking requests. Owners have up to 2 hours to respond to a booking request before an automatic decline is sent on their behalf. Owners who say yes most often (and respond most quickly) feature at the top of search results and are likely to receive the most booking requests.

    The vehicle Owner receives this booking request via email, text and an internal message. This contains the Driver's profile details together with the times and value of this proposed booking.

    The Owner knows that this is an approved safe Driver but can also view profile details including name, location, photo, hire history and any feedback from other Owners relating to previous WhipCar rentals. This request could be from a friend, family member, or from a sensible neighbour who lives nearby.

    Once a booking is accepted an Owner is bound by these terms and liable as per the WhipCar Cancellation and Fines Policy.

  4. Handover Car

    Before a Driver comes to collect your vehicle, please make sure your car:

    • Is clean, meets WhipCar's Vehicle Eligibility Requirements and is appropriate (and safe) for use.
    • Has at least 1/4 tank of fuel.
    • Has an up-to-date condition checklist with any existing damage recorded.

    Once a booking is agreed, Owners receive a confirmation email containing the Driver’s full contact details, including the last 4 digits of their driving licence.

    The Driver must bring both parts of their driving licence (photocard and Paper Counterpart) when they come to collect the car from your pick up location. This enables you to validate their identity. If this is a non-photographic licence, please insist on seeing alternative photo ID (such as a passport) to confirm their details. If they do not have their driving licence on them, you are fully entitled to refuse to hand over your vehicle to them.

    On confirmation of their identity, the Driver will examine the car checking that it is not marked and is free from any obvious faults and damage. Any existing damage should be recorded in an Owner's car condition book - this will be sent to you on registration with WhipCar and can also be downloaded from the "My Car" page in your account.

    Once both parties are happy, the Owner hands over their keys and the Driver drives away for the agreed period of hire.

  5. Car Returned

    An hour before the return time, both parties are sent text and email reminders of the agreed drop off time and location.

    Make sure your car is returned on time and if you know it’s going to be late, call us on 0844 544 2010 so we can extend the insurance. You need to let us know immediately as your WhipCar insurance will only cover the duration of the booking period and failure to do so could invalidate your existing insurance.

    Once the car is returned, check your car condition form again with the Driver to ensure that the car is in the same condition, with the same amount of fuel as prior to rental.

    You must let WhipCar know within 48 hours if your car has been damaged.

  6. Feedback

    Following a booking, both parties must rate one another in order to carry out further bookings. When leaving feedback, we encourage Owners and Drivers to be as pleasant, accommodating and honest as possible to help other users.

    Do not defame, swear or slander. Whatever the experiences you have had, outline it honestly and rate each member as you deem appropriate. Low rated cars are unlikely to receive many booking requests just as low rated Drivers will often have their booking requests declined.

    WhipCar reserves the right to remove any slanderous or libellous review – with absolute discretion.

  7. Get Paid!

    The more bookings you accept, the money you make. You control how much you make depending on the price you set and how often you rent your car out.

    WhipCar Owners are paid on the 15th of the month following on from the month that any bookings ended. For example, rental income for any bookings that end in October are paid on the 15th of November. This payment is made directly into your bank account so please make sure your bank details are up to date or you may miss our monthly payment cycle.

General Conduct

All members must:
  • Provide valid and complete information on their profile and keep this up to date.
  • Avoid posting any defamatory or false claims on reviews
  • Never share any contact information of other members in an online public area
WhipCar Responsibility
  1. WhipCar endeavours to only allow safe Drivers and cars on to the service. To minimise the risk of damage, only safe (vetted/approved with a safe record) Drivers can become WhipCar Drivers. WhipCar will check all participating vehicles and Drivers with a number of third party databases including the DVLA to ensure WhipCar Drivers meet our Driver Eligibility Criteria and vehicles are not stolen or tainted with illegality or fraud. WhipCar are not responsible for the quality or reliability of this data or for human error involved in these processes.
  2. WhipCar does not undertake any safety checks of the private vehicles offered for hire by WhipCar Owners on the website. It is the responsibility of the WhipCar Owner to ensure compliance with the Vehicle Eligibility Requirements and for the WhipCar Driver to be satisfied this responsibility has been discharged.
  3. WhipCar will automatically arrange fully-comprehensive insurance cover provided by a leading Lloyd's insurer on each rental. Claims handling is managed by this third party at their absolute discretion.
  4. WhipCar will not be responsible for incidents caused by rentals. WhipCar Owners and Drivers are fully responsible for their own conduct - we will do our best to police and remove offending parties from future participation.
  5. WhipCar are able to remove vehicles and members from cars at their absolute discretion. We deserve the right to debit cards on booking confirmation and impose fines in line with the Cancellation and Fines Policy at our absolute discretion.

Cancellation and Fines Policy

WhipCar Owner Fines

If you add your car to WhipCar and accept bookings you commit to honouring them. We hope that WhipCar Owners and Drivers can resolve disputes between themselves, but in the event that this is not possible, the fines below are designed to minimise inconvenience caused to WhipCar Drivers who rent your car.

WhipCar Driver Fines

If you place a WhipCar booking you commit to honouring it. The fines below are designed to minimise inconvenience caused to WhipCar Owners who rent out their cars.

Appeals and arbitration process

In the event that a WhipCar Owner or Driver is deemed liable for a fine they will be informed by email and their card debited. This sum is automatically debited from their card but can be challenged by return email or phone. WhipCar reserves the right to request further documentation. WhipCar will consider the Member's challenge and any relevant information, but has the right to accept or refuse the Member's challenge. WhipCar's decision will be final.

Eligibility

How much does it cost to join?

It's completely free to join WhipCar, there are no annual costs or joining fees. Click here to join!

Am I eligible?

We check your driving history with the DVLA. To join WhipCar:

  • You must be at least 21 years old (and no more than 70 years old)
  • You must have held a full UK driving licence (not provisional) for a minimum of 12 months
  • You must have no more than 6 penalty points on your driving licence
  • You can't have had any drink driving convictions in the last 5 years
  • You have no convictions relating to driving without insurance
  • You've had no more than two accidents in the past 3 years
Do you accept non-UK driving licences?

We accept UK and Northern Ireland driving licences only. Unfortunately at present we cannot accept drivers with foreign licences of any kind as we cannot verify their driving history with the DVLA. Rest assured we are working on expanding the range of licences we accept.

What points/endorsements are not accepted?

As per our Eligibility Criteria, if you have more than 6 points on your driving licence, we cannot accept you as a driver on our service. We also do not accept the following driving convictions:

  • IN10 - Using a vehicle uninsured against third party risks
  • BA10, BA30 - Driving or attempting to drive whilst disqualified by order of court
  • CD40, 50, 60, 70, 80 or 90 - Causing death by careless driving
  • DR10, 20, 30, 40, 50, 60, 70, 80 or 90 - Anything relating to drink driving in the last 5 years
Why can't I book certain cars?

If you are under 25 you cannot at present rent cars in certain insurance groups. If you requested to book a car in a higher insurance group and are aged 21 to 24, this is the most likely reason why the booking was declined. If you don't believe this is the case, please drop us an email to hi@whipcar.com outlining the nature of your problem.

Do you accept automatic driving licences?

Yes, we do. Holders of such licences can only hire automatic cars and can find these using the "Advanced Search" option.

Account Administration

How can I amend my account details?

You can amend all your personal details in the Settings tab on the right hand side after you have logged into your WhipCar account. Within this tab, you can amend your email address, contact number, postal address, Driver description and password.

Can I register as both an Owner and Driver?

Yes. However, you will need to create two separate accounts using two different email addresses.

I've forgotten my password and can't login to WhipCar, what do I do?

Simply click on the 'Forgotten your password' link which appears when you sign into your profile (click here). Your password will be reset and you will be emailed your new password details to your registered email address.

Can I add a Second Driver to a booking?

Yes, you can add a second Driver to a booking who must also be a WhipCar member. To add a Second Driver to a booking, simply press the 'add another driver' button at checkout and enter their Username. You can also add a Driver to an existing booking within your account by pressing 'Amend' and entering their username. Please note an Owner must accept any amendments and adding another Driver incurs a £10 fee and a marginal increase to your insurance fee (this is clearly laid out on your payment page).

How do I add a photo to my profile?

You can a photo to your site within your WhipCar profile. Simply log in to your WhipCar profile and click on the 'settings' tab to add or change a photo. Please ensure that your photo is no more than 2mb (1mb is best) and must be saved as a JPEG or PNG file only.

How do I leave the Owner feedback?

Simply log in to your WhipCar profile, click on 'My messages' and then select the message you should have received prompting you to leave feedback, usually entitled 'How did it go? Please feedback on this WhipCar Owner.' Within this message is a link to where you can leave feedback for the Owner saying 'Please rate this Owner here'.

You can also leave feedback for an Owner by going into 'My bookings' and clicking on 'rate' by the appropriate booking in the 'Historical Bookings' section.

I'm having problems with the site, what should I do?

If you are having an issue with the site it could be caused by your Internet connection. If you feel that this isn't the case, please email any relevant screenshots with a description of the problem(s) you are encountering to hi@whipcar.com.

How do I close my WhipCar Driver Account?

If you would like to permanently close your profile you can log in to the 'My Account' page, click on 'Settings' and then scroll down the page where you will see the 'delete profile' option. Simply enter your password and click 'delete my account'.

Bookings

How do I book a car?

We recommend that you read through our How it Works and Terms and Conditions sections to get a good understanding of how WhipCar works. Booking a car is easy, simply Sign up as a driver and once you are fully verified by our screening process, you can place booking requests online.

Are there any mileage restrictions?

WhipCar Owners can outline on their profile page if they would like to impose any particular mileage restrictions on use of their vehicle. WhipCar Drivers need to abide by any such restrictions imposed and should look for them before booking any car. We always suggest checking this with an Owner if you are planning a long trip.

Who pays for fuel?

The Driver pays for fuel. Owners must ensure that their car has at least a 1/4 of tank full before the booking commences. The Driver must return the car with the same amount of fuel as prior to rental. WhipCar is unable to compensate/refund either party for fuel discrepancies but reserves the right to suspend or terminate any member (Owner or Driver) if it determines that they have behaved inappropriately.

Can you smoke in vehicles?

Smoking is not permitted in any vehicle unless the Owner specifically gives you permission to do so. Owners can indicate on their profile if smoking is allowed, but in the absence of anything indicating this, there is strictly no smoking in all WhipCar vehicles.

What are the rules on pets?

Drivers are not prohibited by WhipCar from taking pets in vehicles, but Owners can indicate on their profiles if they don't allow Drivers to take pets in their vehicles. If this is the case, Drivers must abide this.

Can I drive outside of the UK?

No, the insurance is only valid for driving in mainland UK (not Northern Ireland).

When will I receive a response?

You will receive a response within two hours for any booking you place within daytime hours (9am-10pm). If you submitted after this time you will receive a response by 10am the following morning.

Why do my booking requests get rejected by Owners?

If the car you have selected is unavailable we will contact other nearby owners and suggest alternatives to you. If your requests are continually being rejected, please ensure that you have uploaded a suitable photo to your profile and edited your profile description. We find that doing this greatly reassures Owners and increases your chances of securing a booking. However if you have done as above and still cannot secure a booking with a particular Owner, we suggest trying an alternative vehicle.

Can I amend a booking?

You can amend a booking before it takes place for free (providing the duration of the amendment is the same or less than when you first booked). To amend a booking click on 'amend' by the appropriate booking in the 'bookings' tab of your profile. Please note that the car Owner will need to accept any booking amendments and there may be additional costs if the duration of rental is extended or you add an additional Driver.

What if I'm running late and need to extend a booking?

Check that the car Owner is happy to extend this booking and then call WhipCar on 0844 544 2010. Our team will automatically extend insurance cover.

What happens if I get into an accident during hire?

Remain calm and pull to the side of the road out of harm's way. If there is another car or cars involved in the accident, ask for their vehicle registration and insurance certificates. Do not admit liability for anything and call WhipCar on 0844 544 2010 to report the accident and initiate an insurance claim, if applicable.

What if the car breaks down during hire?

Call WhipCar on 0844 544 2010 and we will provide you with roadside assistance if necessary.

Can a car be picked up and/or dropped off at different address from the one on the site?

In general, booked cars are picked up and dropped off at the address at which an Owner's vehicle is registered. However, Owners are free to accept and decline bookings as they wish and manage their bookings themselves. If you would like to pick up/drop off a car at a different location to where the car is registered, we would suggest asking the Owner directly whether this is possible.

Do I need to clean the car before I return it to the Owner?

Our policy is that the Vehicle (with its keys and all peripheral items, including manuals, wheel locking nuts etc) must be returned to the WhipCar Owner in the same condition as it was at the beginning of the Hire Period. Therefore after a long period of hire, the vehicle may require washing in order to return it in its pre-rental condition.

What if I need to return the car early?

Please contact the WhipCar Owner directly and see whether this is possible. If the WhipCar Owner is unavailable it is your responsibility to return the car and keys at the agreed return time laid out in the booking confirmation. Unfortunately, you will not be reimbursed for any unused time if you return the car early.

How do I cancel a booking?

Log in to your account to cancel any booking. Either party (WhipCar Owner or WhipCar Driver) is free to cancel a booking at any time but there may be associated fees for the inconvenience caused to the other party. See our Cancellation and Fines Policy.

What is an Eager Owner?

An Owner who accepts two booking requests in a row is classed as an 'Eager Owner' and will appear at the top of search listings. You can refine your vehicle search to look specifically for Eager Owners by pressing the 'Eager Owner' icon at the top of search results.

What happens if the owner of the car I want declines my request?

If an Owner of a car you request declines your response, we recommend that you try alternative vehicles. We also recommend messaging any Owners to help build up rapport with them and ensuring that you have provided a detailed profile description with a suitable photo(s)

What kind of ID do I need to pick up a car?

You must bring your driving licence (the photocard and paper counterpart) and your booking reference number to collect the car. No other form of ID is acceptable and a WhipCar Owner will not hand over their car unless these are presented to them.

Money/Payments

How much does it cost to rent a car?

Owners set their own prices. WhipCar Drivers pay the WhipCar Owner's list price, our partner's dynamically generated insurance premium and a £3.00 booking fee. When you select the car(s) you would like to book, these costs are clearly outlined in your basket before you submit your booking.

When is payment taken from my card ?

When a booking is placed, WhipCar will check that they have sufficient funds in their account to cover this booking cost (including the insurance excess payable in the event of an accident). No money is ever debited from any card until the booking has been accepted by an Owner and confirmed. If your payment fails, please resubmit the booking request using an alternative card.

How do payments work?

All our payments are carried out outline and we accept most major credit/debit cards (except American Express). You provide your payment details as part of our sign up process and these details are used when you make a booking request. However you are only ever charged once a vehicle Owner accepts this request. If the booking request expires, you will not be debited.

How much is the insurance excess?

If you are involved in an accident when driving a WhipCar you will be liable for the first £500 of damage caused. However, for £5 per day you can purchase a Damage Excess Waiver (DEW) at checkout and lower this exposure to £250.

When will I be charged for the booking?

When an Owner accepts your booking, the rental amount, booking fee and Insurance Premium are debited from your bank card. As per our Cancellation and Fines policy, if you cancel the booking any time up to 24hrs before the booking start, you will get a partial refund less the cost of the insurance, any damage excess waiver (if purchased) and a £10 administration fee. No refunds are issued for cancellations less than 24 hrs before the booking is due to begin.

How does WhipCar make money from Drivers?

WhipCar is free to join and makes money by charging WhipCar Owners a success fee (15% + VAT of the rental price) and Drivers a transaction fee (£3.00) when placing a booking.

Why don't you show all the booking costs in search listings?

Insurance is arranged through our partners at Lloyd's of London and the premium applicable to each booking varies according to the type of car, location and age of the Driver. However you do receive a full breakdown of all the costs in your car basket, before you proceed to book.

When will I receive the £5 for referring a friend?

You will automatically receive a £5-off discount code as soon as the person you recruit becomes active. A Driver is classed as active as soon as they make a booking whilst an Owner becomes active when they accept a booking.

My card payment is not processing, what can I do?

If your card is not processing it could be for a number of reasons. Please check to ensure that the address where your card is registered matches your WhipCar profile address (must be an exact match). Alternatively check that you have entered the correct security card number (3 digits on back of card) and any other card details. If these factors still don't explain the problem, please email hi@whipcar.com with any relevant details or screenshots.

I still haven't received my refund for a booking, what do I do?

Please ensure that you have fully understood our Cancellation and Fines Policy. If you are entitled to a refund and have been notified that this has been issued, please allow up to 7 working days for the funds to appear back on your card (depending on your bank). If you still haven't received your refund after 7 working days, please email us at hi@whipcar.com.

Can I use someone else's card to pay for bookings?

No, the card you use must be your own credit or debit card and you will provide these details as part of the registration process.

How do I use a voucher code?

If you receive a voucher code from an Owner or from WhipCar, simply input this in the appropriate box in your car basket. The total price for the booking should automatically adjust itself once you have inputted the correct code. Please note that voucher codes are case sensitive.

I'm having problems submitting my payment

Our payment gateway is very sensitive and the most likely reason for a problem is due to the address of your WhipCar profile differentiating from your bank card address (they must be an exact match). Please also check that you have filled in the appropriate card details, including the security number on the back of the card as this also tends to be a common reason for payment failure.

Do you take a deposit?

We do not take a deposit for any bookings but we do run a security check to ensure that you would be able to meet our insurance excess in the event of an accident.

Insurance

Is there any insurance excess?

Yes, drivers are liable to pay a £500 insurance excess if damage occurs during any WhipCar booking. WhipCar offers Drivers the option to purchase a Damage Excess Waiver (DEW) for every hire. The Excess Waiver costs £5 per day and reduces the Driver's financial liability from £500 to £250 in the unfortunate circumstance that a WhipCar Owner's car is damaged during hire.

What if someone rents my car and leaves the keys inside and the door unlocked?

This hasn't ever happened but as with most UK car insurance policies, WhipCar's Insurer does not provide cover in the event that keys are left in a car that is then stolen. It is the duty of the WhipCar Owner to be satisfied with the person to whom they are renting their vehicle as the custodian of their car. In the event that a WhipCar Driver causes loss owing to such negligence, WhipCar reserves the right to pursue the Driver for any loss incurred.

What about damage?

Your car is insured by our partners at Lloyd's of London during WhipCar bookings. When your car is returned from each booking you need to follow WhipCar's drop-off checklist. Claims rest with WhipCar's partners (not our own insurance).

Is wear and tear covered by insurance?

No, as is consistent with all car insurance policies, wear and tear is not covered.

Does your insurance cover trailers/caravans or towing objects?

No, unfortunately it is not currently possible to tow an object using a WhipCar due to restrictions we have with our insurance policy. However we are looking to develop the ability to do this in the near future so please watch this space!

Does the insurance policy cover European driving?

No, the insurance is only valid for driving in mainland UK (not Northern Ireland). Cars cannot be taken out of Great Britain.

How much does it cost to join?

It's completely free to join WhipCar. Once you have registered we'll send you a personalised member pack in the post. Click here to join!

Is my car eligible?

To join WhipCar:

  • You must have a car (no vans, motorbikes or motorhomes at the moment)
  • It can't be more than 8 years old
  • It must have a valid MOT and road tax
  • You must have existing insurance (the WhipCar insurance policy temporarily supersedes your existing insurance cover for the duration of the booking)
  • You must meet WhipCar's vehicle eligibility requirements and be suitable for use (safe to drive, in good condition and clean)
  • You can't have had a major accident in the last 3 years or written-off your vehicle
Do you accept non-UK licence plates?

Unfortunately we cannot currently accept foreign licence plates as we are unable to check the vehicle history so that it meets our eligibility criteria.

Why won't you accept my vehicle?

Please check to ensure that your vehicle meets our Eligibility Criteria. Whilst millions of cars across the UK are eligible for WhipCar, we are currently unable to accept vehicles which are in the highest insurance groups. It could be that your postcode isn't currently covered by our insurance partners. Alternatively with newer vehicles (under 2 months old), the DVLA database may not yet be up-to-date with the vehicle data. In this case we recommend checking with the DVLA directly to ensure that the correct information is on their database. If you believe that your vehicle meets all of our criteria and you have checked the above, please email hi@whipcar.com and we'll investigate this further.

Do you accept personalised/dateless registration plates?

We cannot currently accept personalised and/or dateless registration plates because these plates can be transferred from car to car which means we cannot provide you with a rental valuation for your vehicle. However we are working on accepting these types of plates in the future.

Do you accept non-UK licence plates?

Unfortunately we cannot currently accept foreign licence plates as we are unable to check the vehicle history so that it meets our eligibility criteria.

Do I need to have existing insurance on my vehicle in order to join WhipCar?

Yes, you must have existing insurance on your vehicle. This is required by UK law and without this your car is not eligible for WhipCar.

What happens when a vehicle surpasses your 8 year age limit?

For insurance reasons, we don't currently accept vehicles which are over 8 years old. If you register a vehicle and it becomes over 8 years old whilst on the service, it will become ineligible and will no longer appear in search results.

Do you accept vehicles which are leased or subject to a finance agreement?

WhipCar Owners must own their cars. If you are a car Owner who is subject to finance or a lease hire agreement you should check this with your finance/lease provider before placing your car on our service.

If I'm in the motor trade can I add cars to your site?

Yes, you can add an unlimited number of cars to WhipCar providing that you are the registered Owner, they meet our eligibility criteria and are fit for purpose (see our Terms & Conditions). If your vehicles are subject to finance or you have trade insurance and you have any doubts, we always recommend checking with your respective providers. Please also note that you will need a different email address for each profile you create.

Which cars are the most popular on your site?

The popularity of vehicles on our site varies according to location. However you can see details of popular cars in your area by clicking on an Owner's profile in your area and scrolling down to where it says 'popular cars'.

Do you recommend buying any particular vehicles?

Ultimately the popularity of cars depends on the area and demand from Drivers. However you can see details of popular cars in your area by clicking on an Owner's profile and scrolling down to where it says 'popular cars'.

Account Administration

Can I register as both an Owner and Driver?

Yes. However, you will need to create two separate accounts using two different email addresses.

Can I have more than one car on your site?

Yes. However, you will need to create separate accounts using different email addresses.

Can I register my vehicle in more than one location?

No, your car will appear in search results at the registered address which matches your credit card billing address.

How can I amend my personal details?

You can amend all your personal details such as your username, postal address, bank details, mobile number and password by logging into your account and clicking on the settings tab on the right hand side.

How can I amend my car details?

You can amend all your car details by:

  • Logging into your WhipCar Owner profile and clicking on the 'Your Dashboard' tab.
  • Click on the 'show profile status' button at the top of your profile
  • Choose number 4 - 'settings' and click on the 'update' button.

Within this section of your Owner's profile you can:

  • Edit information - you can alter your car description. Make it informative and friendly
  • Edit specifications - edit particular details of your car such as engine size, mileage and fuel
  • Edit pricing - instantly edit your daily, weekly and monthly rental rates
How do I leave the Driver feedback?

You can leave feedback for a Driver by going into 'My bookings' and clicking on 'rate' by the appropriate booking in the 'Historical Bookings' section. You should also have received a message in your Message box with a link to leave feedback for the Driver. Please also note that in order to get paid, you must provide feedback for any Drivers who have rented your vehicle.

I've forgotten my password and can't login to WhipCar, what do I do?

Simply click on the 'Forgotten your password' link which appears when in the sign in forms (click here). Your password will be reset and you will be emailed your new password details to your registered email address.

Why isn't my car appearing in search listings?

Owners have the option of maintaining a private profile or a public profile. If your profile is set to private, your vehicle won't appear in search results but you can still send your profile details to your friends or family. You can switch your profile back to public at any time by simply logging in to your WhipCar profile, clicking on the 'Your Car' tab and then where it says 'Car profile privacy,' select 'public'.

Owners who do not respond to booking requests may also have their profiles automatically switched from public to private. However an Owner can quickly switch their profile back to public by doing the above.

How do I close my WhipCar Owner Account?

If you would like to permanently delete your profile you can do so by going into the My Account page, click on 'settings' and then scroll down the page where you will see the delete profile option. Simply enter your password and click 'delete my account'.

When will I receive my Owner's pack?

We no longer send Owner's pack in the post. However you can download all the Owner's materials from within your WhipCar profile. This includes your in-car booklet and Owner's Guide.

How much demand will there be for my car?

The demand for your car depends on a variety of factors including your location, car type and price. If you are currently experiencing low demand for your vehicle you could alter your car price, offer discount codes to your favourite Drivers or use some of your WhipCar flyers to help promote your vehicle.

How do I create discount codes?

You can create discount codes in your WhipCar profile. Simply click on voucher codes within the 'Your car' tab and you can set voucher codes at your desired discount. Once you have generated a discount code you simply send it to any Drivers.

How do I add car photos to my profile?

You can add photos of your vehicle within your WhipCar profile. After logging in, click on the 'settings' tab to add or change a photo. Please ensure that your photo(s) is no more than 2mb (1mb is best) and must be saved as a JPEG or PNG file only.

I'm having problems with the site, what should I do?

If you are having an issue with the site it could be caused by your internet connection. If you feel that this isn't the case, please email any relevant screenshots with a description of the problem(s) you are encountering to hi@whipcar.com.

How does it work?

We recommend that you read through our How it Works and Terms and Conditions sections to get a good understanding of how WhipCar works.

Will my car be safe?

WhipCar delivers enhanced consumer protection measures to WhipCar Owners by screening a Driver's driving history with the DVLA before they can place a booking. We provide automatic breakdown cover and 24/7 support and all bookings are insured by our partners at Lloyds of London. You will always be in full control of who uses your car and can accept or decline any booking requests.

How often does my car need to be available?

You can hire out your car from a minimum of 3 hours to a maximum of 3 months - it's up to you. Once you have added your car to WhipCar you can control your vehicle availability and simply accept or decline booking requests when you receive them.

Can I impose mileage restrictions for a booking?

WhipCar Owners can outline on their profile page if they would like to impose any particular mileage restrictions on their vehicle. In the absence of such restrictions, Drivers are encouraged to abide by our fair use policy by informing the Owner when placing a booking if they intend to drive the car for more than 50 miles per day.

What happens if a Driver incurs a speeding fine, congestion charge or parking fine etc?

If you receive the notification of a speeding fine, parking fine or congestion charge or any other offence which was incurred during a WhipCar booking, the first step is to contact the Driver. You should provide them with all the details including instructions to pay or transfer it into their name. If you are unable to contact the Driver, please scan and email the details to hi@whipcar.com or post it to WhipCar Ltd, 41 Great Portland Street, London W1W 7LA. We will then help chase this up with the Driver and cooperate with the DVLA/police where applicable.

What happens if a Driver doesn't have their driving licence on them when they collect a car or it is being renewed?

As per our site Terms and Conditions, WhipCar Owners have absolute discretion to accept or decline any booking requests. A core component of the car handover process is confirming the identity of the Driver collecting this car which MUST be carried out by reference to their driving licence (the last 4 digits of which you have on your booking confirmation form). Alternative forms of identification cannot be accepted and in the event that this is a paper-only licence, additional photographic identification (e.g. a passport) must also be provided.

What the Driver is running late and need to extend a booking?

Please contact WhipCar immediately on 0844 544 2010 so we can automatically extend insurance cover to protect your vehicle until it is returned.

Who pays for fuel?

The Driver pays for fuel. Owners must ensure that their car has at least a 1/4 of tank full before the booking commences. The Driver must return the car with the same amount of fuel as prior to rental. WhipCar is unable to compensate/refund either party for fuel discrepancies but reserves the right to suspend or terminate any member (Owner or Driver) if it determines that they have behaved inappropriately.

Who do I contact if an issue arises?

When a booking is made you will automatically receive the Driver's contact details. WhipCar Drivers and Owners should always contact one another directly to clarify directions or any issues that may arise.

How do I cancel a booking?

Either party (WhipCar Owner or WhipCar Driver) is free to cancel any booking at any time, however there are associated fees payable for the inconvenience caused to the other party. See our Cancellation and Fines Policy.

What is an Eager Owner and how do I become one?

An Owner who accepts two booking requests in a row is classed as an 'Eager Owner' and will appear at the top of search listings. You will automatically become an Eager Owner if you accept two booking requests in a row.

How long do I have to reply to booking requests?

Bookings can be responded to through your WhipCar account or by text message. Owners have one hour to respond to booking requests that are received within daytime hours (9am-10pm). If a booking request is placed by a Driver after this time, the Owner will have until 10am the following day to respond.

Can I accept bookings through my phone?

Yes - simply respond to any booking request you receive with ACCEPT or DECLINE followed by the appropriate booking number sent in this text. An example acceptance text would be 'ACCEPT 5140' and a decline text would be 'DECLINE 5140'.

Money/Payments

How much money will I make?

Enter your postcode and number plate here and WhipCar will tell you how much we think your car could make based on the vehicle age, model and existing demand from our members in your area. You are always in complete control and can choose to use this suggested price or set your own price. The more bookings you accept, the more money you make.

How much do WhipCar take from an Owner's income?

WhipCar automatically deducts 15% + VAT from an Owner's rental income. This is displayed in an Owner's payment summary.

How and when will I get paid?

Owners are paid on the 15th of the month following a completed booking. For example, rental revenue made in June will be paid by the 15th July. This payment is paid directly into your bank account so please ensure your details are up-to-date in your profile. Please note that it can take 1 to 5 working days for your bank to process any payments.

I don't think I've been paid the correct amount?

WhipCar deducts 15% + VAT from your monthly paycheque which is reflected in your payment summary. You can find this within your bookings tab. If you believe that you have been incorrectly paid or the amount received differs from what is displayed in your profile, please contact us at hi@whipcar.com so we can investigate this further.

Why haven't I been paid yet?

Our payment dates are always scheduled for the 15th of the month following on from when a booking ends. Please note that it can take 1 to 5 working days for the funds to process in your bank account (depending on your bank). Please also check to ensure that we have the bank correct details for you by clicking on the 'settings' tab of your profile, if we don't have these, you may miss our monthly payment cycle.

1.Introduction

    The Whipcar service enables [Whipcar Members to make Bookings and hire Vehicles from each other.] Use of the Whipcar service is conditional upon full compliance with this Agreement. [Currently, Whipcar only facilitates Bookings and the hiring of Vehicles for use in [the United Kingdom].]

  • 1.2

    This Website is owned and operated by Whipcar Limited, incorporated in the UK with company registration number 06934250 and a registered address of 41 Great Portland Street, London, W1W 7LA.

  • 1.3

    This Agreement is made between: (1) Whipcar, and (2) you, in connection with your use of the Website and / or in your capacity as a Whipcar Member. Provisions in this Agreement that apply to Whipcar Members apply to everyone who has registered with Whipcar, whether or not they are registered as a Whipcar Driver and / or a Whipcar Owner. In addition:

    • 1.3.1

      provisions specifically applicable to Whipcar Owners will apply to you if you are a registered Whipcar Owner; and

    • 1.3.2

      provisions specifically applicable to Whipcar Drivers will apply to you if you are a registered Whipcar Driver.

    Capitalised terms used in this Agreement have the meanings set out in the Definitions Section set out at clause 2 below.

  • 1.5

    Whipcar reserves the right to update this Agreement at any time. If Whipcar amends this Agreement, Whipcar will publish the amended version on the Website. The amended Agreement will take effect from the time it is first published on the Website, and from then on will govern the relationship between Whipcar and Whipcar Members and / or Website users. Unless expressly provided in writing, such amendments will not however apply to any Pre-Amendment Booking, which will remain binding and otherwise subject to the terms of this Agreement. Any user and / or Whipcar Member who does not agree with the amended Agreement, must not continue to use the Website after the time on which the amended Agreement is published on the Website, save that any such Member who has made or accepted a Pre-Amendment Booking(s) shall be entitled to use the Website solely for the purposes of and in connection with the making and fulfilment of such Pre-Amendment Booking(s) but for no other purpose.

    From time to time Whipcar may ask you to agree to further terms and conditions relating to additional services that Whipcar may make available through the Website, for example in relation to entering into competitions or purchasing items or new services from Whipcar. In such circumstances, this Agreement will continue to apply save that, in the event of any conflict between it and any terms and conditions relating to such additional services, the terms and conditions relating to the additional services shall prevail.

In this Agreement the following capitalised terms mean:

'Agreement' these terms and conditions plus the terms and conditions applicable to any additional services and the specific terms and conditions agreed in any Booking;
'Basic Safety Requirements' the requirements set out in clause 9.4;
'Booking' any completed agreement between a Whipcar Driver and a Whipcar Owner made through the Booking Procedure for the Whipcar Driver to use a Vehicle for a Hire Period in return for a Rental Fee, in accordance with this Agreement;
'Booking Fee' The £3.00 fee payable by a Driver to Whipcar for handling a booking;
'Booking Procedure' the procedure for making a Booking, described here;
'Code of Conduct' the Whipcar code of conduct, as amended from time to time, and which is set out here;
'Collision Damage Waiver' is described in Clause 19;
'Damage Excess Waiver' is described in clause 20;
'Driver Eligibility Criteria' are set out in clause 4.2;
'Driver Registration Process' the process used by Whipcar Drivers to create their Profiles on the Website;
'Extension Period' the period of time by which the relevant Whipcar Owner and Whipcar Driver agree under clause 7.3 to extend any Initial Hire Period;
'Hire Period' the Initial Hire Period plus any Extension Period agreed by the relevant Whipcar Owner and Whipcar Driver in respect of a Booking in accordance with this Agreement;
'including' or any term similar to it such as, 'for example', does not limit the wording which follows;
'Initial Hire Period' the period of time that the relevant Whipcar Owner and Whipcar Driver have agreed through the Booking Procedure for use of a Vehicle;
'Insurance Fee' the sum payable by WhipCar Drivers for the insurance cover for each Booking, under the Insurance Policy;
'Insurer' Liberty Syndicate Management Limited, for and on behalf of Lloyd’s Syndicate 4472;
'Member' or 'Members' refers to all Whipcar Members and 'Member' refers to anyone who falls in these groups;
'Cancellation and Fines Policy' is set out here;
'Pre-Amendment Booking' means any Booking made prior to the date and time on which any amendment to this Agreement is made and which is not due to have been fulfilled until after such time;
'Privacy Policy' the Whipcar privacy policy, as amended from time to time, and which can be found here;
'Profile' a Member's profile on the Website;
'Rental Fee' the fee agreed through the Booking Procedure to be paid by the relevant Whipcar Driver to the relevant Whipcar Owner for use of a Vehicle during a Hire Period (excluding any costs relating to fuel, penalties or damage to the Vehicle);
'Success Fee' the fee payable by an owner for bookings made through the WhipCar platform. Fee set as 15% + VAT of Whipcar Owner revenue received in respect of the Booking;
'Vehicle Booking Shortlist' a feature available under the Booking Procedure where a Whipcar Driver simultaneously requests use of several Vehicles for the same Hire Period, with the Booking being concluded when the first Whipcar Owner on the shortlist accepts the request;
'Vehicle Condition Log' the hard copy log that every Whipcar Owner must keep with the Vehicle, keep up to date, and make available to Whipcar Drivers, in which Members must record any damage to the Vehicle of which they have become aware (both interior and exterior). Registered WhipCar Owners can download this log from their profile page.
'Vehicle Eligibility Criteria' are set out in clause 3.2;
'Vehicle Registration Process' the process used by Whipcar Owners to create their Profile and register Vehicles on the Website;
'Vehicle' a car, compliant with the Vehicle Eligibility Criteria, made available for hire by a Whipcar Owner in accordance with this Agreement;
'Website' the whipcar.com website and the content, features and services offered through it;
'Whipcar Driver' a Member registered with Whipcar as an individual eligible to agree from time to time to hire a Vehicle from a Whipcar Owner in accordance with this Agreement;
'Insurance Policy' the insurance policy arranged by Whipcar and which can be found here;
'Whipcar Member' a person who has registered with Whipcar;
'Whipcar Owner' a Member who has registered any eligible Vehicle(s) with Whipcar as being available for hire in accordance with this Agreement;
'Whipcar Owners Excess Claims Form' In the event that you need to pursue a claim to recoup your excess, these forms will be provided on request;
'Whipcar' Whipcar Limited, incorporated in the UK with company registration number 06934250 and a registered address of 41 Great Portland Street, London W1W 7LA.
3.Registering Vehicles with Whipcar
  • 3.1

    Any person with a car that meets the Vehicle Eligibility Criteria, and who otherwise complies with the terms of this Agreement, may become a Whipcar Owner by creating a Profile and registering the Vehicle(s) through the Vehicle Registration Process.

  • 3.2

    A Whipcar Owner's Vehicle(s) must meet all the following Vehicle Eligibility Criteria on the date of registration and for the full period during which the Vehicle is registered with Whipcar. The Vehicle(s) must:

    • 3.2.1

      be a car as defined by the DVLA;

    • 3.2.2

      be owned (or leased) by the Whipcar Owner;

    • 3.2.3

      be no more than 8 years old;

    • 3.2.4

      have a valid MOT certificate and road tax;

    • 3.2.5

      be insured; and

    • 3.2.6

      meet the Basic Safety Requirements and otherwise be safe to drive, clean, in good condition, and suitable for use.

  • 3.3

    By completing the Vehicle Registration Process each Whipcar Owner warrants to Whipcar and any Whipcar Drivers who make any Booking in respect of the Vehicle that the Vehicle meets and (save in respect of any failure which is beyond the control of the Whipcar Owner) will continue to meet during each and every Hire Period the Vehicle Eligibility Criteria.

  • 3.4

    If after becoming registered as a WhipCar Owner any Vehicle(s) ceases to meet the Vehicle Eligibility Criteria, the WhipCar Owner must immediately remove the Vehicle from their Profile. As soon as a WhipCar Owner becomes aware that any Vehicle(s) no longer meets the Vehicle Eligibility Criteria the WhipCar Owner must not accept any Bookings for that Vehicle and must cancel any Booking where the Hire Period has not yet commenced. The WhipCar Owner will bear all the costs and liabilities (if any) associated with any such cancellation.

  • 3.5

    Whipcar may refuse to register (or may cancel the registration of) any Vehicles if it considers or is aware they do not meet the Vehicle Eligibility Criteria.

  • 3.6

    If a Vehicle that has been registered subsequently fails to meet the Vehicle Eligibility Criteria and the Whipcar Owner does not remove the Vehicle from the Whipcar Owner's Profile, Whipcar may if it is aware of the failure remove the Vehicle from the Whipcar Owner's Profile, but has no obligation to do so. Whipcar will incur no liability for any Bookings that can no longer be fulfilled [but clause 3.4 will apply to any Bookings cancelled where the Hire Period has not yet commenced].

  • 3.7

    As part of the Vehicle Registration Process Whipcar will automatically search for the Vehicle against one or more third-party databases in order to check the Vehicle's age, model, registration, and accident history. The results of this check will be assessed by Whipcar and Whipcar may at its discretion refuse to register the Vehicle.

  • 3.8

    [The Booking Procedure will require Whipcar Owners to confirm that the relevant Vehicle meets the Vehicle Eligibility Criteria each time they accept a booking request.] Whipcar Owners must keep their Profile details up to date, including updating details of their Vehicles when they change, and informing Whipcar immediately if the Whipcar Owner becomes aware that his / her Vehicle(s) no longer meet the Vehicle Eligibility Criteria.

4.Registering Drivers with Whipcar
  • 4.1

    Any person who meets the Driver Eligibility Criteria, and otherwise complies with the terms of this Agreement, may become a Whipcar Driver by registering with Whipcar through the Driver Registration Process.

  • 4.2

    Individuals wanting to become Whipcar Drivers must be able to meet the following criteria on the date of registration and for the full period during which they are registered as a Whipcar Driver. The Driver Eligibility Criteria are that the person must:

    • 4.2.1

      be a private individual not less than 21 and not more than 70 years of age;

    • 4.2.2

      have held a valid, full (not provisional) UK driving licence for at least the 12 months immediately prior to registration, and remain in possession of such licence throughout the period that the Whipcar Driver remains registered with Whipcar;

    • 4.2.3

      have no more than 6 penalty points on their driving licence;

    • 4.2.4

      have no drink driving convictions (excluding any which were incurred more than 5 years prior to the date of registration with Whipcar);

    • 4.2.5

      have no convictions relating to driving dangerously and/or without insurance;

    • 4.2.6

      have had no more than two accidents in the past 3 years (calculated initially from the date of registration and then subsequently from the date of each booking request).

  • 4.3

    By completing the Driver Registration Process each Whipcar Driver warrants to Whipcar and any Whipcar Owners who accept any booking requests for their Vehicles from the Whipcar Driver that the Whipcar Driver meets the Driver Eligibility Criteria.

  • 4.4

    If after becoming registered as a Whipcar Driver a Whipcar Driver ceases for any reason to meet the Driver Eligibility Criteria the Whipcar Driver must immediately remove his / her Profile from the Website. As soon as a Whipcar Driver becomes aware that he / she cannot meet the Driver Eligibility Criteria the Whipcar Driver must not make or attempt to make any Bookings and must cancel any where the Hire Period has not yet commenced.

  • 4.5

    Whipcar may refuse to register (or may cancel the registration of) any individuals as Whipcar Drivers if it considers or is aware they do not meet the Driver Eligibility Criteria.

  • 4.6

    If a Whipcar Driver who has registered subsequently fails to meet the Driver Eligibility Criteria, and the Whipcar Driver does not remove his / her Profile from the Website, Whipcar may if it is aware of the failure remove the Whipcar Driver's Profile, but has no obligation to do so. Whipcar will incur no liability for any Bookings that can no longer be fulfilled but clause 4.4 will apply to any Bookings cancelled where the Hire Period Has not yet commenced.

  • 4.7

    [The Booking Procedure will require Whipcar Drivers to confirm that they meet the Driver Eligibility Criteria each time they make a booking request.] However, Whipcar Drivers must keep their Profile details up to date, and must inform Whipcar immediately if a Whipcar Driver becomes aware that it no longer meets the Driver Eligibility Criteria.

5.Booking a Whipcar
  • 5.1

    All Bookings for Vehicles must be made through, and every Whipcar Driver and Whipcar Owner must comply with, the Booking Procedure.

  • 5.2

    Whipcar Owners have absolute discretion to accept or decline any booking request.

  • 5.3

    Once any request has been accepted by a Whipcar Owner through the Booking Procedure, the Booking will be binding on both the Whipcar Owner and Whipcar Driver in accordance with this Agreement, and both Members agree to be bound by and comply with the terms of the Insurance Policy.

  • 5.4

    If a Whipcar Owner does not respond to any booking request within 24 hours of it being placed, Whipcar will send an automatic decline response to the Whipcar Driver who placed the request. Any attempt by the Whipcar Owner to accept the booking request after 24 hours will be invalid.

  • 5.5

    Bookings may be made to commence up to 30 days after the acceptance of the booking request.

6.Vehicle Booking Shortlists
  • 6.1

    The Booking Procedure allows Whipcar Drivers to make simultaneous booking requests for several Vehicles in respect of the same proposed Hire Period, intending only to conclude a Booking in respect of one of the Vehicles on the Vehicle Booking Shortlist they have created.

  • 6.2

    When the first Whipcar Owner of any Vehicle on a Vehicle Booking Shortlist accepts a booking request in accordance with the Booking Procedure, that Booking will be binding on both the Whipcar Owner and Whipcar Driver in accordance with this Agreement and the specific terms agreed.

  • 6.3

    Any attempts by any Whipcar Owner to accept any booking request that has already been accepted, or at any time 24 hours after the booking request was placed, will be invalid.

7.Hire Period
  • 7.1

    Initial Hire Periods must be for a specific duration, of at least 3 hours and not more than 1 calendar month.

  • 7.2

    Any time spent inspecting the Vehicle at collection and return will be included in the Hire Period.

  • 7.3

    Initial Hire Periods may be extended by the Whipcar Driver agreeing an Extension Period with the Whipcar Owner through the Booking Procedure. Whipcar Owners have absolute discretion as to whether to agree to any extension request, and have no obligation to monitor their Profile [or phone] to be responsive to extension requests. If the Driver is late returning the Vehicle, they will automatically be charged additional pro rata Rental Fees and Insurance Premium for the extension to the Hire Period.

  • 7.4

    If the Whipcar Owner does not respond to an extension request within 15 minutes of it being [placed on the Whipcar Owner's Profile], Whipcar will send an automatic decline response. Any attempts by any Whipcar Owner to accept any extension request that has been automatically declined, will be invalid.

  • 7.5

    If a Whipcar Driver fails to return a Vehicle by the end of the Hire Period the Whipcar Driver will be liable in accordance with the Members' Penalties and Compensation Policy.

  • 7.6

    [If no Extension Period is agreed the Insurance Policy will not apply beyond the end of the Initial Hire Period. The Whipcar Driver shall be liable for all damage caused to the Vehicle and any other vehicles or property, or injury to persons, while the Vehicle is uninsured and for any applicable criminal penalties.]

8.Cancelling a Booking
  • 8.1

    Bookings may only be cancelled in accordance with this Agreement.

  • 8.2

    Whipcar Drivers may without penalty cancel any booking request before it has been accepted by a Whipcar Owner through the Booking Procedure.

  • 8.3

    Whipcar Owners must refuse to allow a Whipcar Driver to take control of a Vehicle if, in the Whipcar Owner's reasonable opinion, the Whipcar Driver is unfit to drive, does not meet the Driver Eligibility Criteria, appears to be intending to use the Vehicle in a way contrary to this Agreement, or in the circumstances set out in clause 9.7. The Whipcar Owner will incur no penalties for this cancellation and will not be required to refund the Rental Fee.

  • 8.4

    Whipcar Drivers must refuse to take control of any Vehicle if they reasonably consider that the Vehicle does not meet the Vehicle Eligibility Criteria and may do so in the circumstances set out in clause 9.6]. Any decision by a Whipcar Driver to take control of a Vehicle which is damaged (other than where such damage is purely cosmetic) shall be at the Whipcar Driver's risk. The Whipcar Driver will be refunded for this booking in line with the fines and cancellation policy.

  • 8.5

    Members are otherwise free to cancel any Booking at any time and the Members' Penalties and Compensation Policy will apply accordingly.

9.Vehicle Collection
  • 9.1

    The Whipcar Driver and Whipcar Owner must meet at the time and location agreed in accordance with the Booking Procedure.

  • 9.2

    The Whipcar Owner must ensure that the Vehicle is provided in accordance with the Vehicle Eligibility Criteria and in the condition shown in the Vehicle Condition Log.

  • 9.3

    The Whipcar Driver is responsible for inspecting the Vehicle (both interior and exterior) and requiring the Whipcar Owner to record any discrepancies in the Vehicle Condition Log.

  • 9.4

    In UK law the driver of the vehicle is responsible for the roadworthiness of the vehicle he / she is driving, and as such it is essential that the Whipcar Driver inspects the Vehicle and in particular confirms that the Vehicle meets the following basic safety requirements. The Basic Safety Requirements are as follows:

    • 9.4.1

      all warning lights go off automatically immediately after the ignition is engaged;

    • 9.4.2

      there is no indication of leaking fluids near the vehicle;

    • 9.4.3

      no part of the car, except the tyres, is in contact with the ground;

    • 9.4.4

      windscreens and windows are free from cracks and chips;

    • 9.4.5

      all panels, bumpers, mirrors and mouldings are secure;

    • 9.4.6

      front and rear light lenses are undamaged;

    • 9.4.7

      tyre treads are at least 2mm deep and the tyres are free from deformities and damage; and

    • 9.4.8

      all necessary peripheral items are with the Vehicle including user manual, wheel jack, spare tyre, and locking wheel nuts.

  • 9.5

    In the event that any of the items of damage or problems listed in clause 9.4 above are present in the Vehicle, the Whipcar Driver may cancel the Booking on the basis that the Vehicle is not fit for purpose at pickup, and the Members' Penalties and Compensation Policy will apply.

  • 9.6

    Other damage must be recorded (marked, signed, and dated) in the Vehicle Condition Log by the Whipcar Owner. Refusal to do so will entitle the Whipcar Driver to cancel the booking, and the Members' Penalties and Compensation Policy will apply.

  • 9.7

    The Whipcar Driver must show to the Whipcar Owner the booking reference number provided by Whipcar for the Booking, and provide his / her driving licence. Failure to do so will entitle the Whipcar Owner to retain control of the Vehicle and cancel the Booking, and the Members' Penalties and Compensation Policy will apply.

  • 9.8

    Whipcar Owners should ensure that they have not left any belongings in the Vehicle prior to the Whipcar Driver taking control of the Vehicle. If any belongings are left, they are left entirely at the Whipcar Owner's risk and Whipcar shall incur no liability in respect of any loss or damage to them.

  • 9.9

    Whipcar Drivers must call Whipcar immediately on 0844 544 2010. if during the Hire Period (or any period outside of the Hire Period during which a Whipcar Driver remains in possession of or responsible for the Vehicle) they discover damage or any fault not recorded during the collection inspection, or if any damage is caused to or any fault occurs with the Vehicle.

10.Conditions of Vehicle Use
  • 10.1

    The Vehicle must be driven only by the Whipcar Driver named in the Booking and the following conditions apply to the use of any Vehicle during the Hire Period (or any period outside of the Hire Period during which a Whipcar Driver remains in possession or responsible for the Vehicle). The Whipcar Driver:

    • 10.1.1

      must not use the Vehicle for hire or reward;

    • 10.1.2

      must not use the Vehicle for any illegal purpose;

    • 10.1.3

      must not use the Vehicle off-road, or for racing, pace making, testing the Vehicle's reliability and speed, or teaching someone to drive;

    • 10.1.4

      must not use the Vehicle when under the influence of alcohol or drugs;

    • 10.1.5

      must not carry a number of passengers which exceeds the designed seating capacity of the Vehicle;

    • 10.1.6

      must not carry baggage which would cause the Vehicle to be overloaded;

    • 10.1.7

      must not carry any hazardous, toxic or flammable materials in the Vehicle;

    • 10.1.8

      must not drive the Vehicle in or take the Vehicle to countries other than England, Scotland and Wales;

    • 10.1.9

      must always use the Vehicle in accordance with all highway and other applicable laws and regulations which may be in force at any time;

    • 10.1.10

      must ensure that the Vehicle is locked when not using it;

    • 10.1.11

      must make sure that the correct fuel is used when refuelling the Vehicle (and in the event of fuel contamination the Whipcar Driver will be liable for all costs relating to recovery, decontamination, repair or replacement of any parts, as a result of that failure to add the correct fuel);

    • 10.1.12

      is responsible for the Vehicle, and anything that happens to it, from the moment they take control of the Vehicle until either the later of the end of the Hire Period or the time they return control of the Vehicle to the Whipcar Owner, including any consequential costs incurred due to the state, location and security of the Vehicle at the end of use;

    • 10.1.13

      must not sell, rent or dispose of any Vehicle or any of its parts, or purport to give anyone any legal rights over the Vehicle;

    • 10.1.14

      must not smoke or allow others to smoke in, or allow any animals into, the Vehicle without written permission from the Whipcar Owner;

    • 10.1.15

      must not use or permit the Vehicle to be used to jump start any other vehicle; and

    • 10.1.16

      must not use or permit others to use the Vehicle to tow any other vehicle without written permission from the Whipcar Owner.

11.Vehicle Return
  • 11.1

    By the end of the Hire Period, the Whipcar Driver must return the Vehicle to the location agreed through the Booking Procedure into the control of the Whipcar Owner. If this is not done the Members' Penalties and Compensation Policy will apply.

  • 11.2

    For the avoidance of doubt, after taking possession of a Vehicle, Whipcar Drivers remain responsible for the Vehicle until it has been returned to the possession of the Whipcar Owner in accordance with this Agreement, regardless of whether it is returned during, at the end of, or after the expiry of, the relevant Hire Period.

  • 11.3

    Whipcar Drivers should not return Vehicles to Whipcar Owners before the end of the Hire Period unless agreed otherwise with the Whipcar Owner. If a Vehicle is returned early, the full Rental Fee for the Booking will still be payable.

  • 11.4

    The Vehicle (with its keys and all peripheral items, including manuals, wheel locking nuts etc) must be returned to the Whipcar Owner in the same condition as it was at the beginning of the Hire Period.

  • 11.5

    The Whipcar Owner and the Whipcar Driver must inspect the Vehicle (interior and exterior), and record its fuel level on its return. If there is new damage to the Vehicle the Whipcar Driver will be liable under the Members' Penalties and Compensation Policy, and all new damage (not recorded prior to the commencement of the Hire Period in the Vehicle Condition Log) must be recorded in the Vehicle Condition Log and in a Whipcar Owners Excess Claims Form and must be reported to Whipcar within 48 hours of the Whipcar Owner becoming aware of the damage.

  • 11.6

    Significant new damage (damage which would cost more than the excess on the Insurance Policy) caused to the Vehicle during the Hire Period will be covered by the Insurance Policy, subject to the terms of the policy, and provided that such damage is reported to Whipcar promptly. Members must provide accurate statements and co-operate with the Insurance Policy provider in any way as required by it and provide all information requested by Whipcar or its insurers, if a claim needs to be made.

  • 11.7

    Damage caused to the Vehicle outside of the Hire Period, or any damage expressly stated to be not covered by the Insurance Policy, will not be covered by the Insurance Policy, and Whipcar Drivers will be liable for all such damage. For the avoidance of doubt, liability for any damage caused to any Vehicle during any time that a Whipcar Driver has responsibility for or is in possession of the Vehicle (whether during a Hire Period or otherwise), and which is not covered by the Insurance Policy for any reason, shall lie with the Whipcar Driver.

  • 11.8

    Whipcar Drivers should ensure that they have not left any belongings in the Vehicle prior to the Whipcar Owner taking control of the Vehicle. If any belongings are left, they are left entirely at the Whipcar Driver's risk and Whipcar shall incur no liability in respect of any loss or damage to them.

12.Fuel Policy Refuelling and Incidental Expenses
  • 12.1

    Whipcar Owners should provide Vehicles to Whipcar Drivers at the start of each Hire Period with at least a quarter tank of fuel.

  • 12.2

    Whipcar Drivers should check and record the fuel level before taking control of the Vehicle and should return the Vehicle with at least the same amount of fuel as at the commencement of the Hire Period. Whipcar Owners should check the fuel level when the Vehicle is returned.

  • 12.3

    Where there is a disagreement over fuel levels at the collection or return of any Vehicle the Members should attempt to resolve this between themselves. Neither Member, nor Whipcar, shall be liable under this Agreement in respect of any disagreement about fuel levels. For the avoidance of doubt, no penalties will be incurred under the Members' Penalties and Compensation Policy in respect of fuel provision, except that where a Whipcar Owner provides a Vehicle with no fuel it shall be deemed not fit for purpose at pick up and the Members' Penalties and Compensation Policy will apply.

  • 12.4

    If a Whipcar Driver has to incur any incidental expenses (each item under £10) for essential routine maintenance that becomes necessary during the Hire Period (such as oil, or screen fluid), the Whipcar Driver and Whipcar Owner shall agree between themselves how to deal with this. Whipcar or Whipcar Owners shall have no obligation to reimburse Whipcar Drivers for incidental expenses.

  • 12.5

    Whipcar Drivers should not incur any major expenses in respect of a Vehicle. In the event of accident or breakdown clause 21 will apply.

13.Whipcar's Responsibilities and Liability
  • 13.1

    Whipcar has the right to enforce this Agreement (and the specific terms of any Booking) against Members for any failure(s) to comply with this Agreement.

  • 13.2

    Where this Agreement or any other part of the Website states that Whipcar will do something, Whipcar will use reasonable endeavours to do that thing, or will use reasonable endeavours to procure that the Website provides that function (for example sending text and email reminders in respect of bookings).

  • 13.3

    Whipcar will use reasonable endeavours to maintain and operate the Website but accepts no liability in respect of any part of the Website being unavailable for any period of time. [Whipcar will use reasonable endeavours to maintain and operate its phone contact but accepts no liability in respect of this being unavailable for any period of time.]

  • 13.4

    Whipcar does not guarantee that the Website or Whipcar's service will be error-free, uninterrupted or that it will provide specific results. The Website is provided on an "as-is" and "as-available" basis. Except as expressly set out in this Agreement, Whipcar expressly disclaims any further warranties, conditions, or other terms, either express or implied by statute or otherwise including the implied warranties of merchantability, satisfactory quality or fitness for purpose.

  • 13.5

    Whipcar accepts no liability in respect of the accuracy of any information or data received from third parties, including the results of Whipcar vetting any Members or carrying out checks on Vehicles.

  • 13.6

    Whipcar accepts no liability in respect of and shall not be responsible for:

    • 13.6.1

      the condition of any Vehicle;

    • 13.6.2

      any information or content provided by Members on their Profiles or elsewhere on the Website or in connection with the hiring of any Vehicle;

    • 13.6.3

      death or personal injury except where resulting from Whipcar's negligence;

    • 13.6.4

      any damage to any property, or damage to or loss of any Vehicle;

    • 13.6.5

      any damage or loss of any belongings left in any Vehicle;

    • 13.6.6

      any fuel costs;

    • 13.6.7

      any incidental expenses;

    • 13.6.8

      any charges or fines mentioned in clause 17;

    • 13.6.9

      any theft or breakdown of any Vehicle;

    • 13.6.10

      (subject to making payments when received under the Members' Penalties and Compensation Policy) any cancellation, or failure to honour the terms of, any Booking by any Member; or

    • 13.6.11

      any cancellation of any booking, or removal of any Member Profiles, Vehicles, or other content, from the Website, if done in accordance with this Agreement.

  • 13.7

    Subject to clauses 13.8 and 13.9 below, Whipcar is not liable to any Member under or in connection with this Agreement whether for negligence, breach of contract, misrepresentation or otherwise, for:

    • 13.7.1

      loss or damage incurred by any Member in connection with any claims made by a third party;

    • 13.7.2

      loss of profit, goodwill, business opportunity or anticipated saving suffered by the Member; or

    • 13.7.3

      any indirect or consequential loss or damage suffered by any Member.

  • 13.8

    Subject to clauses 13.9, 13.10, and 13.11, the entire liability of Whipcar to any Member under or in connection with this Agreement whether for negligence, breach of contract, misrepresentation or otherwise, is limited to the amount of the Rental Fee for each Booking made by such Member plus any compensation payable under the Members' Penalties and Compensation Policy, and the amount of any sums which would be payable under the Insurance Policy but for Whipcar's failure to comply with this Agreement.

  • 13.9

    Where Whipcar's total financial liability cannot be calculated in accordance with clause 13.7 (because the liability has arisen otherwise than in relation to a Booking), Whipcar's entire liability to any Member or any other person under or in connection with this Agreement whether for negligence, breach of contract, misrepresentation or otherwise, is limited to £100.

  • 13.10

    Whipcar shall only be liable to pay Rental Fees to Whipcar Owners and compensation to Members to the extent that Whipcar has received these amounts from the relevant Member(s). [Payments made under the Insurance Policy will be managed by WhipCar's Insurance partners].

  • 13.11

    Nothing in this Agreement will operate to exclude or restrict Whipcar's liability for:

    • 13.11.1

      death or personal injury resulting from negligence;

    • 13.11.2

      Whipcar's fraud or negligence.

14.Pricing and Payments
  • 14.1

    [All Members must provide Whipcar with their bank account details into and from which Whipcar can make payments as authorised under this Agreement.]

  • 14.2

    Each Whipcar Owner must set and display on his / her Profile a price for the hire of the relevant Vehicle(s), expressed as an hourly and / or daily rate. Whipcar Owners are free to change their rates at their discretion from time to time though any agreed Rental Fee for a Booking may not be changed, [without the [written] agreement of the Whipcar Driver].

  • 14.3

    Whipcar's Rental Pricing Guidance is provided for guidance only and is not binding on Members.

  • 14.4

    The actual Rental Fee payable in respect of each Booking shall be agreed between the Whipcar Owner and Whipcar Driver through the Booking Procedure.

  • 14.5

    By placing a booking request Whipcar Drivers agree that the Rental Fee, the Booking Fee, the Insurance Fee (including, as applicable, agreed or automatic extensions), and any and all of the following potential additional payments will be charged to the debit or credit card used by the Whipcar Driver to secure the Booking. The potential additional payments that may be charged to the debit or credit card of the Whipcar Driver are payments required:

    • 14.5.1

      to meet the excess on the Insurance Policy;

    • 14.5.2

      because the Whipcar Driver has incurred a penalty and/or must pay compensation under the Members' Penalties and Compensation Policy;

    • 14.5.3

      in respect of loss or damage resulting from a failure by the Whipcar Driver to comply with or breach of this Agreement;

    • 14.5.4

      in respect of all fines and court costs for parking, traffic or other offences (including any costs which arise if the Vehicle is clamped or towed) incurred by the Whipcar Driver during his / her Vehicle use or as a direct result of such use;

    • 14.5.5

      in respect of any other fines and penalties incurred by the Whipcar Driver as a result of failure to comply with this Agreement or in connection with their hiring or use of any Vehicle;

    • 14.5.6

      in respect of Whipcar's costs, including, but not limited to, reasonable legal fees and any debt recovery or court fees incurred in collecting payments overdue from a Whipcar Driver;

    • 14.5.7

      in respect of value added tax and all other taxes and levies on any of the charges listed in this clause, as applicable from time to time; and

    • 14.5.8

      in respect of any other money due to Whipcar from a Whipcar Driver under this Agreement.

  • 14.6

    Conclusion of any Booking in accordance with the Booking Procedure shall constitute authority for Whipcar to debit all monies due against the Member's nominated credit or debit card at the times specified in clause 14.7 and 14.8 below, including any of the items listed in clause 14.5 (Whipcar Drivers) above and in clause 14.9 below (Whipcar Owners).

  • 14.7

    Payments for the Rental Fee, Insurance Fee and Booking Fee will be charged to the Whipcar Driver's debit or credit card at the moment a booking is accepted by the Owner.

  • 14.8

    All other payments due in accordance with this Agreement will be charged to the Whipcar Driver's debit or credit card on demand as they fall due.

  • 14.9

    Whipcar Owners must provide a debit or credit card for Whipcar to take payments required under this Agreement. By accepting a booking request through the Website Whipcar Owners authorise Whipcar to take the following payments as and when they fall due:

    • 14.9.1

      any payments due because the Whipcar Owner has incurred a penalty and/or must pay compensation under the Members' Penalties and Compensation Policy;

    • 14.9.2

      any payments due in respect of loss or damage resulting from a failure to comply with this Agreement;

    • 14.9.3

      any payments due in respect of Whipcar's costs, including, but not limited to, reasonable legal fees and any debt recovery or court fees incurred in collecting payments overdue from a Whipcar Owner;

    • 14.9.4

      any payments due in respect of value added tax and all other taxes and levies on any of the charges listed in this clause, as applicable from time to time; and

    • 14.9.5

      any payments due in respect of any other money due to Whipcar from a Whipcar Owner under this Agreement.

  • 14.10

    If a debit card or credit card is declined by the card issuer, leaving any Member with an outstanding balance, then if the Member is a Whipcar Owner he / she must not accept any booking requests, and if the Member is a Whipcar Driver he / she must not make or attempt to make any booking requests, until full payment of the outstanding balance is received by Whipcar.

  • 14.11

    Where a Member's credit history has not been established to Whipcar's satisfaction or becomes questionable in Whipcar's opinion, the Member must provide Whipcar on demand a copy of his / her passport and two proofs of address (not more than 2 months old). Whipcar may request these at any time while the Member is registered on the Website.

  • 14.12

    Members whose payments fail will accrue penalties in accordance with the Members' Penalties and Compensation Policy.

  • 14.13

    Whipcar will pay all Rental Fees received on completed bookings in respect of a Whipcar Owner's Vehicle in each month, to the Whipcar Owner on the 15th day of the following month.

  • 14.14

    Whipcar may be entitled to keep for itself as payment for providing the Whipcar service, all Booking and Success Fees. [WhipCar's partners may keep all Insurance Fees (subject to Whipcar maintaining the Insurance Policy)].

15.Members' General Responsibilities and Indemnity
  • 15.1

    Members must provide Whipcar with correct information when registering on the Website (including, and without limitation, the Member's name, address, age, and driving history). It is the Member's responsibility to update Whipcar and the relevant sections of the Website, including the Member's Profile, with any changes to this information during their Membership.

  • 15.2

    Members must comply with Whipcar's Code of Conduct.

  • 15.3

    Each Member hereby indemnifies and agrees to keep Whipcar indemnified against all losses, liabilities, claims or demands arising out of:

    • 15.3.1

      any failure by the Member to comply with, or any breach by the Member of the terms of, this Agreement (including the terms of any Booking, and any failure to pay any money due);

    • 15.3.2

      any breach of warranty given as to either the Vehicle Eligibility Criteria in respect of any Vehicle, or the Driver Eligibility Criteria in respect of any Whipcar Driver;

    • 15.3.3

      any claim by a third party (or another Member) that any content posted by the Member on the Website breaches the intellectual property rights of the third party or any of the warranties given in clause 23;

    • 15.3.4

      any death or personal injury other than that resulting from Whipcar's negligence.

  • 15.4

    If you are renting out your car with us, you are responsible both for determining whether any VAT is chargeable and for collecting that VAT - this means in general that you should include any VAT in the price you list with us for use of your car. WhipCar are responsible only for any VAT payable on the 15% commission we charge. WhipCar does not pay any taxes on behalf of the users of the service. Users are solely liable for any taxes resulting from and rental agreement or use of our services or site. Whether you are a business entity or an individual you agree that you are solely responsible to determine what taxes, if any, apply to you and to pay such taxes. WhipCar recommends that you seek advice from a tax professional.

16.Penalties and Compensation
  • 16.1

    By registering on the Website Members agree to pay Whipcar the amounts specified for the relevant penalties as set out in the Members' Penalties and Compensation Policy in the circumstances set out in this Agreement and / or the Cancellation and Fines Policy.

  • 16.2

    Whipcar agrees to procure the payment to Members of the amounts specified for the relevant compensation set out in the Members' Penalties and Compensation Policy in the circumstances set out in this Agreement and / or the Members' Penalties and Compensation Policy.

17.Traffic Offences and Fines / Congestion Charging
  • 17.1

    Whipcar Drivers are liable for any costs incurred as a result of any and all traffic offence penalties which relate to a Hire Period (or any period outside of the Hire Period during which a Whipcar Driver remains in possession of or responsible for the Vehicle) including parking tickets, speeding fines, clamping fines, bus lane fines and compound charges, and for any further penalties specified in the Members' Penalties and Compensation Policy.

  • 17.2

    Whipcar Drivers are responsible for paying any tolls, fees or charges which they may incur during a Hire Period (or any period outside of the Hire Period during which a Whipcar Driver remains in possession of or responsible for the Vehicle), including the Dartford crossing toll and Toll Road fees, and the London Congestion Charge.

  • 17.3

    Wherever possible it is the Whipcar Driver's responsibility to pay the relevant authorities directly. Whipcar Drivers must provide a written report of any offences committed to Whipcar and the Whipcar Owner on return of the Vehicle.

  • 17.4

    In the case of speeding notices Whipcar Owners are obliged by law to pass on the offending Whipcar Driver's details to the Police who will then contact the Whipcar Driver directly.

  • 17.5

    If a Whipcar Driver decides to appeal any tickets, fines or other charges, the Whipcar Driver shall do so at its own cost, and shall remain liable both for the relevant amount and under the Members' Penalties and Compensation Policy pending the outcome of the appeal.

18. Insurance Cover
  • 18.1

    All Vehicles registered with Whipcar are automatically covered for the duration of any Hire Period by the Insurance Policy. Whipcar will maintain the Insurance Policy.

  • 18.2

    The insurance policy arranged by WhipCar is designed to not prejudice or otherwise affect the Whipcar Owner's or Whipcar Driver's existing insurance. However, we recommend that all members verify this with their existing insurers. The Vehicle will be covered by the insurance arranged by WhipCar throughout the hire period.

  • 18.3

    Whipcar Drivers are liable to pay the excess on the Insurance Policy.

  • 18.4

    Members are advised to read the "key facts" summary of the Insurance Policy, and the full terms of the Insurance Policy.

  • 18.5

    There are a number of conditions which must be satisfied before the insurance policy is taken out. Members should check that they are complying with these as the insurance policy may not cover them if they are not met. Members should note that the Insurer has the right to take action against a WhipCar Driver in the event of a claim, where the WhipCar Driver is (partially or completely) at fault or acts or fails to act in a manner that contributes to the loss.

  • 18.6

19.Collision Damage Waiver
  • 19.1

    All bookings automatically include Collision Damage. Collision Damage Waiver will waive WhipCar Drivers' liability to pay for any damage caused to the Vehicle during the Hire Period, subject to the exclusions listed below. The WhipCar Driver's liability is waived subject to he or she paying a charge, referred to as an "excess", which limits the damage liability to the cost of the excess only.

  • 19.2

    Collision Damage Waiver covers most circumstances, where damage has been caused to the Vehicle during the Hire Period. However it is subject to certain exclusions which include where:

    • 19.2.1

      damage is caused to windows/windscreen, interior, wheels, tyres, underside or roof of the Vehicle;

    • 19.2.2

      any Vehicle has been driven off-road and or has been driven on un-tarmacked roads and or has been driven without due care and attention and or has been driven negligently;

    • 19.2.3

      the WhipCar Driver is under the influence of alcohol or drugs;

    • 19.2.4

      the driver of the Vehicle has not been named on the Booking; and

    • 19.2.5

      damage is caused by the Vehicle being towed away by any unauthorised third party.

20.Damage Excess Waiver
  • 20.1

    Whipcar Drivers may purchase from Whipcar a Damage Excess Waiver which offers reimbursement for any excess paid as a result of accidental damage during the Hire Period. Whipcar Drivers with a Damage Excess Waiver remain liable for the excess on the Insurance Policy but are entitled to claim under the Damage Excess Waiver, subject to its terms, for reimbursement of the amount paid against the excess.

  • 20.2

    Claims must be made against the Damage Excess Waiver within 28 days of the relevant incident. Exclusions to this policy apply where:

    • 20.2.1

      the Vehicle has been driven off-road or on non-tarmac roads;

    • 20.2.2

      the Vehicle has been driven without due care or attention, or negligently;

    • 20.2.3

      the Whipcar Driver was under the influence of alcohol or drugs;

    • 20.2.4

      the Whipcar Driver has not been named in the Booking;

    • 20.2.5

      damage is caused by the Vehicle being towed by any third party; and

    • 20.2.6

      [any contravention of any of the Vehicle Eligibility Criteria or the Conditions of Vehicle Use in clause 9 may also invalidate the Damage Excess Waiver.]

21.Accident Theft or Breakdown
  • 21.1

    If a Whipcar Driver is involved in an accident he / she must not admit responsibility but must immediately:

    • 21.1.1

      contact Whipcar by phone;

    • 21.1.2

      take the names addresses and contact details of everyone involved;

    • 21.1.3

      make the Vehicle secure to the extent possible and phone the Police.

  • 21.2

    If a Vehicle is stolen during a Hire Period (or any period outside of the Hire Period during which a Whipcar Driver remains in possession or responsible for the Vehicle) the Whipcar Driver must as soon as becoming aware of the theft contact Whipcar by phone and phone the Police.

  • 21.3

    If a Whipcar Owner becomes aware that his / her Vehicle(s) has been damaged or stolen the Whipcar Owner must contact Whipcar by phone within 48 hours of becoming aware.

  • 21.4

    Whipcar has no liability in respect of damage to or theft or breakdown of any Vehicle, or any related costs whether directly or indirectly incurred, [except to the extent recovery of any loss is not possible under the Insurance Policy due to Whipcar's failure to maintain the Insurance Policy in accordance with this Agreement.]

  • 21.5

    Any breakdown involving a Vehicle must be reported to Whipcar by phone at the earliest opportunity.

  • 21.6

    During the Hire Period (or any period outside of the Hire Period during which a Whipcar Driver remains in possession or responsible for the Vehicle), if a problem arises that prevents or limits the use of the Vehicle or that may compromise peoples' safety, the Whipcar Driver must immediately contact Whipcar and park the Vehicle in accordance with Whipcar's instructions.

  • 21.7

    Whipcar will use reasonable endeavours to assist Members in dealing with the consequences of any damage theft or breakdown, but has no obligation to incur any costs or expenditure when doing so.

  • 21.8

    Members must provide accurate statements and co-operate with the Insurance Policy provider in any way as required by them. Members who fail to provide requested information may be held liable for the full repair costs and other direct costs incurred.

  • 21.9

    Whipcar Drivers must not arrange to, or themselves, carry out any repair work without the Whipcar Owner's prior written permission and Whipcar Owners must not, if they intend to claim against the Insurance Policy, arrange to, or themselves, carry out any repair work without Whipcar's (and its insurer's) prior written permission.

22.Data Protection
  • 22.1

    For the purposes of the Data Protection Act 1998, Whipcar will act as a data controller in relation to Member information provided to Whipcar. By registering with Whipcar, Members consent to Whipcar processing, as defined under the Data Protection Act and set out in this Agreement and the Privacy Policy, any personal information that a Member provides to Whipcar.

23.Member Communication and Forums
  • 23.1

    Members may contact Whipcar [at any time by email] and by phone on 0844 544 2010.

  • 23.2

    Members may contact each other via the messaging button on one another's profile page, through the Booking Procedure, and any other way particular Members may agree.

  • 23.3

    Members may not publish content on the Website that:

    • 23.3.1

      infringes the intellectual property rights of any third party or that is defamatory, offensive, discriminatory or otherwise unlawful;

    • 23.3.2

      is fraudulent or otherwise misleading;

    • 23.3.3

      invades any person's privacy;

    • 23.3.4

      contains any virus or other malware designed to or which might interfere with Whipcar's or any third party's systems or data;

    • 23.3.5

      contains political campaigning, commercial solicitation, mass marketing or any form of spam; or

    • 23.3.6

      is unfair, deceitful or harmful.

  • 23.4

    Whipcar reserves the right to remove from the Website any content published by Members at any time. Whipcar has no obligation to do so, but will use reasonable endeavours to remove any content from the Website when contacted by any Member or third party and asked to do so if the content is or appears to have been posted in breach of this Agreement.

  • 23.5

    By contributing any content or information to the Website, Members grant to Whipcar a perpetual, a non-exclusive, royalty-free right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media, and grant Whipcar the right to use the Member's name in connection with such content.

  • 23.6

    Members agree that these rights are irrevocable during the entire period of protection of the intellectual property rights associated with such content. Members agree to waive any right to be identified as the author of such content and any right to object to derogatory treatment of such content. Members agree to perform all further acts necessary to perfect any of the above rights granted at Member's own cost, including the execution of deeds and documents, at the request of Whipcar.

  • 23.7

    Members represent and warrant that they own or otherwise control all of the rights to the content that they contribute.

  • 23.8

    Whipcar will communicate with Members by [phone, e-mail and text message]. Where the communication is for the purposes of marketing or sales, communication will be restricted to e-mail and text message and an opt-out mechanism will be provided in accordance with the Privacy Policy.

  • 23.9

    Whipcar will use e-mail to convey important operational information and changes to this Agreement, and it is the Member's responsibility to keep their contact details up-to-date.

  • 23.10

    Telephone calls and other correspondence with Whipcar may be recorded or monitored. By using these communication methods Members consent to the recording or monitoring of their communications.

  • 23.11

    Use of the Website is subject to the Privacy policy

24. Dispute Resolution
  • 24.1

    If any dispute arises between Members relating to the Whipcar service, including any Booking, Members must resolve it between themselves. If requested in writing by all Members involved in a dispute, Whipcar will at its discretion assess any information provided by Members relating to the dispute and make an indicative resolution. The Members do not have to accept Whipcar's indicative resolution.

  • 24.2

    Without prejudice to his/ her legal rights, if any Member wishes to challenge any penalty charged by Whipcar under the Members' Penalties and Compensation Policy, Whipcar will consider the Member's challenge and any information provided relevant to it, but will not be bound to accept the Member’s challenge.

25. Termination of Membership
  • 25.1

    Subject to clause 25.2, Whipcar may without liability remove any Member’s Profile from the Website, and terminate its relationship with the Member, at any time and for any (lawful) reason. Whipcar may refuse to allow any Member to re-register with Whipcar for any (lawful) reason.

  • 25.2

    Where any Member has outstanding Bookings which it is yet to fulfil, Whipcar may only exercise its right in clause 25.1 where the Member has acted unlawfully and / or breached the terms of this Agreement (or any Booking). The breach does not have to be material.

  • 25.3

    If Whipcar exercises its rights under clause 25.1, it will not affect Whipcar's right to receive any money owed to it or arrange for the payment of any money owed by the Member to any other Member under this Agreement. Any money owed to Whipcar at the time of termination will become immediately due and payable and Members grant Whipcar the right to set off any amounts owing against any money Whipcar is holding on behalf of the Member.

  • 25.4

    If a Member acts unlawfully and / or in breach of this Agreement, Whipcar may where it considers appropriate give such Member's personal details to credit reference agencies, HM Revenue & Customs, the Police and other law enforcement agencies, debt collectors, or any other relevant organisation.

  • 25.5

    Except in certain circumstances where a Member has acted unlawfully or in breach of this Agreement, Members may remove their Profile from the Website at any time. This will not affect Whipcar’s right to receive any money owed to it under this Agreement.

26. Events Beyond the Reasonable Control of Whipcar and / or Members
  • 26.1

    Whipcar shall not be liable for either a failure to perform or delay in performing any of its obligations if, and in so far as, performance is delayed, hindered or prevented by any event beyond the reasonable control of Whipcar.

  • 26.2

    [Members shall not be liable to each other for either a failure to perform or delay in performing any of their obligations if, and in so far as, performance is delayed, hindered or prevented by any event beyond the reasonable control of the relevant Member.]

27. Severance

If any provision of this Agreement (including any Booking) is, or becomes invalid, or unenforceable, the remaining provisions shall be interpreted in such a way so as to remain in effect.

28. Third Party Rights

A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

29. Governing Law

This Agreement and all matters arising from or connected with it are governed by and shall be construed in accordance with English Law.

30. Jurisdiction

The courts of England have exclusive jurisdiction to settle any dispute arising from or connected with this Agreement, including, but not limited to, a dispute regarding the existence, validity or termination of this Agreement or the consequences of its nullity. Members irrevocably submit to the jurisdiction of such courts and agree that the courts of England are the most appropriate and convenient courts to settle any dispute and, accordingly, they will not argue to the contrary.

Comprehensive Cover:
  • Unlimited cover in respect of legal liability for death or injuries to Third Parties.
  • Cover for legal liability for damage to Third Party property limited to £25,000,000* in respect of Private Cars and £5,000,000 for all other vehicle types (*£20,000,000 sub-limit applies for damages)
  • Costs incurred defending charges under the Corporate Manslaughter & Corporate Homicide Act 2007 up to a maximum of £5,000,000
  • Unlimited cover in respect of legal liability for death or injuries to Third Parties
  • Cover for loss or damage to Insured Vehicles caused by fire, theft, or attempted theft (excluding theft if the keys have been left in the vehicle)
  • The cost of the replacement of locks up to a limit of £500 in the event of the theft of the keys of an Insured Vehicle
  • Loss or damage to an Insured Vehicle caused by Fire, Explosion or Theft up to a maximum limit of £10,000,000 in respect of any one loss or series of losses arising from a single event

Making a Claim:

Claims handling services are provided in partnership with our service provider, Countrywide Accident Assistance (CAA). If you need to make a claim please contact WhipCar in the first instance on 0844 544 2010. After the initial report of the claim, CAA will have responsibility for handling the claim, please use their dedicated claims helpline number 0845 505 1600.

Making a Complaint:

If, for whatever reason, you wish to complain about your policy, contact The Compliance Officer, Liberty Syndicate Management Limited, Plantation Place South, 60 Great Tower Street, London EC3R 5AZ or call 020 7070 4472 and ask to speak to a member of the Compliance team or email your complaint to complaints@libertygroup.co.uk.

Financial Services Compensation Scheme (FSCS):

If Liberty Syndicates is unable to meet its liabilities you may be entitled to compensation under the Financial Services Compensation Scheme (FSCS). The level of compensation available under this insurance is 100% of the claim without any upper limit. Further information can be obtained from the Financial Services Compensation Scheme website at http:www.fscs.org.uk or by phoning the FSCS on 0207 892 7300.

Significant or Unusual Exclusions and Limitations

Market Value (Section 2)
The maximum amount that we will pay for any one loss to the Insured Vehicle under the Policy will be the lower of:

  • The Market Value of the Insured Vehicle immediately prior to the loss; or
  • The estimated value of the Insured Vehicle (where appropriate) as declared to Liberty Syndicates

Keys (Section 2 Exception(vii))
You will not be covered if an Insured Vehicle is lost, stolen or damaged by theft or attempted theft whilst the Insured Vehicle is unlocked or the keys are left in the vehicle.

Drivers (General Exception 1)
You may not be covered if you fail to ensure that all drivers of Insured Vehicles hold a valid driving licence of the class required to drive the vehicle concerned.

Excess (Section 2)
When taking out your policy you will be advised of the excess that applies. An excess requires you to pay the first part of any claim, up to the agreed limit.

Excluded Activities (General Exception 8)

  • Use for racing, pacemaking, reliability trials, speed testing or use in connection with motor rallies, competitions or trials
  • Use in connection with the motor trade
  • Use for hiring or the carriage of passengers for hire or reward

Scope

This Privacy Policy describes how we handle your personal data. It applies to personal data collected through your use of the Website and services offered by WhipCar and / or from other interactions with us and other users of the Website and WhipCar members. For example, this Privacy Policy applies to personal data collected by us when you register as a WhipCar Driver or WhipCar Owner, or in connection with renting or hiring a Vehicle using the Website, as well as other services such as customer care or promotions and campaigns.

The controller of your personal data

For the purposes of the Data Protection Act 1998, to the extent that we use your personal data for WhipCar's business or other purposes (for example, to arrange insurance or process a payment to us in connection with a Booking), the data controller in relation to your personal data is WhipCar Limited, Company No: 06934250, 41 Great Portland Street, London, W1W 7LA. In other circumstances, where you make personal data available over the Website for your own purposes (for example, when submitting content and other materials to a discussion group on the Website) or simply to enable us to process a transaction on your behalf, you will remain the data controller in respect of that use of the personal data.

The personal data we collect about you

You can browse our Website without telling us who you are or revealing any personal data about yourself. Once you give us your personal data, you are not anonymous to us. We may collect, periodically check and update and store the following personal data:

  • your name and age;
  • your email address, physical address, telephone number and other physical contact information;
  • your financial information, such as credit card and / or bank account numbers;
  • your location, photograph, Vehicle hire and / or Vehicle rental history and feedback from WhipCar Owners and / or WhipCar Drivers about transactions they have entered into with you on the Website;
  • if you have registered with us as a WhipCar Driver, your driving licence details, its status and related information including information from the Driving and Vehicle Licensing Agency (the "DVLA") confirming, for example, that, at the time of registration, you are at least 21 years of age and not over 70 years of age; you have held your full (not provisional) UK driving licence for a minimum of 12 months; you have no more than 6 penalty points on your driving licence; you have had no drink-driving convictions; you have had no convictions relating to driving without insurance; and that you have had no more than two car accidents in the past 3 years. Following your registration, we will check with the DVLA and collect this information again once every calendar year;
  • If you have registered with us as a WhipCar Owner, information relating to your Vehicle including ownership information, registration number, its age, condition, model, accident history, MOT history, tax history, and insurance coverage;
  • transactional information based on your activities on the Website (such as information relating to hiring / renting a Vehicle, feedback from other Members and content you generate or that relates to your Profile);
  • Member communications, discussions, and other content provided on or via WhipCar's Booking Procedure, correspondence through our Website, feedback, information provided in connection with any dispute and / or its resolution and other correspondence sent to us or via the Website;
  • other information from your interaction with the Website, and our services, content and advertising, including computer and connection information, statistics on page views, traffic to and from the Website, ad data, IP address and standard web log information;
  • additional information we may ask you to submit at any time to authenticate yourself or if we believe you are or may be in breach of Website terms and conditions or policies. For example, we may ask you to send us an ID or bill to verify your address, or to answer additional questions online to help verify your identity or ownership of a Vehicle you list;
  • information from other companies, such as demographic and navigation data; and
  • other supplemental information from third parties (for example, if you incur a debt to WhipCar we may ask you to send us additional information, such as your driver's licence, credit card statement, or a recent utility bill or other information confirming your address, or to answer additional questions online to help verify your information).
The purposes for which we use your personal data

Our primary purpose in collecting personal data is to enable us to provide the services over the Website and provide you with a safe, smooth, efficient, and customised experience. You agree that we may use your personal data to:

  • provide the services (which will include sharing some of your personal data with other Members and third parties in accordance with this Privacy Policy) and any customer support that you request;
  • determine your rating and / or your Vehicle's rating on the basis of the feedback provided by other Members about transactions they enter into with you on the Website;
  • determine your and / or your Vehicle's ranking in search results depending on the number of Bookings you have successfully concluded;
  • resolve disputes, collect Booking Fees, and troubleshoot problems;
  • investigate and / or take action to prevent prohibited or illegal activities, and enforce our Terms & Conditions;
  • maintain, customise, measure and improve our services, the Website, and the content and advertising made available on or by means of the Website and / or our services;
  • tell you about our services, engage in targeted marketing, and provide service updates and promotional offers based on your communication preferences; and
  • compare information for accuracy, and verify it with third parties such as the DVLA, insurance companies and / or credit rating agencies.
Use of your personal data for marketing purposes

We do not share, sell, rent, or trade PII with third parties for their promotional purposes, without your explicit consent. We may combine your information with information of other Members and information we collect from other companies and use it to improve and personalise our services, content and advertising. If you don't wish to receive marketing communications from us or to participate in our ad-customisation programs, you can turn these off on your profile page 'preferences' tab or by contacting us on privacy@whipcar.com

Special Offers and Updates

Newsletters
If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. Receiving our newsletter is required as part of the service that we offer. If you wish to no longer receive our newsletters you may deactivate your account.

We will send you service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email. Our sharing of your personal data

We may disclose personal data to respond to legal requirements, enforce our rights and any policies posted on the Website including this Privacy Policy and our Terms & Conditions, respond to claims that a listing or other content infringes the rights of others, or protect anyone else's rights, property, or safety.

We may also share your personal data with:

  • other WhipCar Members, for example, where you are involved in a transaction with another Member, the other Member will have access to certain personal data including your user name and Profile details including your name, location, photograph, hire or rental history and feedback from other Members with whom you have entered into transactions in the past and will obtain your full contact details via the confirmation e-mail when a Booking is agreed;
  • third parties such as the DVLA and insurance companies for driver or vehicle vetting purposes;
  • other third parties to whom you explicitly ask us to send your information or about whom you are otherwise explicitly notified and consent to;
  • law enforcement agencies, other governmental agencies or third parties in response to a request for information (such as a Section 29 (3) Data Protection Act 1998 form) relating to a criminal investigation, alleged illegal activity or any other activity that may expose us, you or any other person (including WhipCar Members) to legal liability. The personal data we disclose may include your WhipCar user name and user name history, and your name, physical address details, telephone number, email address, fraud complaints and Vehicle renting and Vehicle hiring history or anything else that we deem relevant;
  • service providers under contract who help with our business operations (such as customer support providers, debt recovery agencies, and insurance companies); and
  • if we decide to sell, buy, merge or otherwise reorganise our business, this may involve us disclosing personal data to prospective or actual purchasers and their advisers, or receiving personal data from sellers and their advisers.

Without limiting the above, in an effort to respect your privacy and our ability to keep the WhipCar community of Members safe from those who attempt to carry out fraudulent or illegal activities on the Website, we will not otherwise disclose your personal data to law enforcement, other government officials, or other third parties without a court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of personal data is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

We post customer testimonials/comments/reviews on our web site which may contain personally identifiable information. We will always obtain the customer's consent via email prior to posting the testimonial to post their name along with their testimonial.

Information you share on www.WhipCar.com

Your user name and Profile information is displayed throughout the Website and so is available to other Members and the public and is connected to all of your WhipCar activity. Other Members can see your feedback, ratings and associated comments. If you associate your name with your user name, other Website users may be able to personally identify your WhipCar activities. In any event, if we detect policy breaches and / or other inappropriate or suspicious activity in connection with your use of the services, advisory notices we send to other users may also identify you and / or specific transactions you have entered into through the Website.

If you choose to set your profile as a private account, only Members will be able to see your car details and your Vehicle will not be discoverable through any search results.

Using information from www.WhipCar.com

WhipCar enables you to share personal data to complete transactions. We expect you to respect the privacy of other Members. We cannot guarantee the privacy or security of your personal data when handled by other Website users and therefore we encourage you to take care before entering into transactions / sharing your personal data with others. To help protect your privacy, we allow other Members access only to your Member's Profile (which includes feedback from other Members, hire history and an indication of the area you live in but does not outline your exact location and will not be more specific than the first part of your postcode) to facilitate your transactions. When Members are involved in a transaction, they may have access to each other's name, user name, email address, location, contact and other information. In all cases, you should comply with data protection laws, and comply with other Members' requests to review the information you have collected about them and, subject where appropriate to fulfilment of any contractual obligations relating to any outstanding Bookings, have their personal data removed from your computer or other storage systems.

You agree to use Member information only for:

  • WhipCar transaction-related purposes that are not unsolicited commercial messages; and
  • other purposes that a Member expressly consents to.
Your disclosure of your information to third parties

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are visitors to the Website, WhipCar Members, or others, different rules will apply to their use or disclosure of the information you disclose to them. WhipCar does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We strongly encourage you to ask questions before you disclose your personal data to others.

Use of cookies

From time to time when you visit the Website, information may be placed on your computer to allow us to recognise your computer. This information is commonly in the form of a textfile known as a "cookie". Cookies are small pieces of data stored on your computer's hard drive, rather than on the Website. Protecting your WhipCar account

Your password is the key to your WhipCar account. Use unique numbers, letters and special characters, and do not disclose your WhipCar password to anyone. If you do share your password or your personal data with others, remember that you are responsible for all actions taken in the name and user name of your account. If you lose control of your password, you may lose substantial control over your personal data and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify us and change your password.

Security

We treat your personal data as an asset that must be protected.

There are always risks associated with providing personal data, whether in person, by phone, via the internet or otherwise, and no technology is completely safe, secure or hacker-proof. Therefore we cannot and do not promise, and you should not expect, that your personal data and communications will always remain secure and private.

We strive to protect your privacy by taking appropriate technical and organisational information security measures to prevent and minimise such risks. Such measures include, where appropriate, the use of firewalls, secure server facilities, encryption, implementing proper access rights management systems and processes, careful selection of data processors and other technically and commercially reasonable measures to provide appropriate protection for your personal data against unauthorised use or disclosure. Upon your request to us at privacy@whipcar.com, we will close your account and remove your personal data from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We retain personal data from closed accounts to collect any fees owed, resolve disputes, troubleshoot problems, comply with law, assist with any investigations, prevent fraud, enforce our Terms & Conditions, and take other actions otherwise permitted by law.

In case you wish to know what personal data we hold about you or you wish to update, rectify or delete any incomplete, incorrect or outdated personal data, or you wish us to cease processing your personal data you may also, as appropriate and in accordance with applicable law, exercise such rights by contacting us on privacy@whipcar.com You may also contact us by mail at Privacy Team, WhipCar Limited, 41 Great Portland Street, London, W1W7LA.

In some cases, especially if you wish us to delete or cease the processing of your personal data, this may also mean that we may not be able to continue to provide the services to you. Please note that we may need to ask for additional proof of identification and / or for additional information before responding to any requests from you about the personal data we hold on you, or to update, rectify or delete any incomplete, incorrect or outdated personal data, or to cease processing your personal data. Please also note that a charge of £10 may apply if you wish to obtain a copy of the personal data we hold about you.
